Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the BEOCAST service (the "Service"), including the BEOCAST apps for macOS, iOS, iPadOS and watchOS, as well as the beocast.com website, published by Nabil Jerbi, sole proprietorship (the "Publisher").
By creating an account or using the Service, you accept these Terms in full.
1. Service description
BEOCAST is a peer-to-peer remote desktop solution designed for the Apple ecosystem. It lets an authenticated user control a remote Mac from another Mac, iPhone, iPad or Apple Watch via an end-to-end encrypted connection.
During the beta phase, the Service is provided free of charge, with no commitment, for testing and user feedback. A commercial subscription offering ("BEOCAST Pro") will be launched later and will be subject to specific pricing terms.
2. Account creation
- You must be at least 13 years old to create an account.
- You undertake to provide accurate information (including a valid email address).
- You are solely responsible for keeping your password confidential.
- One account = one individual. Account sharing is prohibited.
3. Acceptable use
You may not use the Service to:
- Access a third-party device without authorization
- Distribute or store illegal, malicious, defamatory content or content infringing third-party rights
- Attempt to bypass security measures, disassemble or reverse-engineer the applications
- Overload or disrupt the infrastructure (denial of service, mass scraping)
- Resell or redistribute the Service without the Publisher's written authorization
- Conduct non-consensual surveillance of any person (zero tolerance for stalkerware)
Any violation results in immediate account suspension and, where applicable, legal action.
4. BEOCAST Pro subscription (future)
When the commercial offering launches, the following terms will apply:
- Pricing: monthly auto-renewing subscription, price displayed on the Pricing page at the time of subscription.
- Trial period: 14 days free for new subscribers, no commitment. The paid subscription starts automatically at the end of the trial unless cancelled beforehand.
- Payment: managed by Apple (iOS purchases) or Stripe (web). The Publisher stores no banking data.
- Cancellation: any time from your Apple account (iOS) or your dashboard (web). No pro-rata refund unless legally required.
- Price changes: 30 days minimum email notice.
5. Right of withdrawal (EU consumers)
Under French Consumer Code Article L. 221-18, you have 14 calendar days to withdraw after subscribing to a paid subscription. However, by starting to use the Service immediately upon subscription, you expressly waive this right of withdrawal pursuant to Article L. 221-28 (services fully performed with express consent).
6. Intellectual property
The Service, its code, interfaces, trademarks and logos are the exclusive property of the Publisher or its licensors. Nothing in these Terms transfers any intellectual property rights to you.
You retain full ownership of any content flowing through your remote sessions — the Publisher never has access to it (end-to-end encryption).
7. Availability and SLA
The Publisher strives to keep the Service available 24/7 but does not guarantee any specific availability level during beta. Maintenance interruptions may occur and will be announced where possible.
Sessions are peer-to-peer: their quality depends on the host's and client's network connection. The Publisher is not liable for degraded quality due to unfavourable network conditions (unstable Wi-Fi, limited bandwidth, strict firewall).
8. Liability
To the extent permitted by French law, the Publisher's liability is limited to proven direct damages. The Publisher shall not be held liable for indirect damages (data loss, business interruption, loss of opportunity) arising from use of the Service.
9. Termination
You may delete your account at any time from your dashboard or by writing to privacy@beocast.com. The Publisher may suspend or terminate an account in case of Terms violation, with reasonable notice unless urgent.
10. Changes to the Terms
The Publisher reserves the right to amend these Terms. Substantial changes will be notified to you by email at least 30 days before taking effect. Continued use of the Service constitutes acceptance of the new Terms.
11. Governing law and jurisdiction
These Terms are governed by French law. In case of dispute, and after attempted amicable resolution, the competent courts shall be those of the consumer's domicile (for EU individuals) or those of the Publisher's registered office (for professionals).
12. Mediation
Under French Consumer Code Article L. 612-1, you may freely refer to a consumer mediator in case of unresolved dispute. Mediator details: [to be completed before Pro launch].
